These Terms of Service govern purchases from and use of devtrafficsystems.com, operated by DEV Construction Corp. under the assumed name DEV Traffic Systems (“DEV Traffic Systems,” “we,” “us,” or “our”).

By using this website or purchasing products from DEV Traffic Systems, you agree to these Terms and any additional terms or policies applicable to your order.

1. Products and Product Information

DEV Traffic Systems sells traffic-control equipment, replacement components, construction-related equipment, and associated products.

We make reasonable efforts to provide accurate product descriptions, photographs, dimensions, specifications, compatibility information, pricing, and availability.

Minor differences in appearance, packaging, labeling, or manufacturing revisions may occur when they do not materially change the product advertised.

Certain technical specifications may originate from manufacturers or suppliers. Where identified as manufacturer-listed specifications, customers should understand that these specifications are based upon information provided to DEV Traffic Systems by the applicable manufacturer or supplier.

Any certification, registration, testing standard, regulatory approval, or compliance designation will be represented as applying to a product only when DEV Traffic Systems has a reasonable basis for stating that it applies to that specific product.

2. Orders and Acceptance

Submitting an order does not necessarily constitute final acceptance of the order.

We reserve the right, where permitted by law, to cancel or decline an order because of product unavailability, pricing or listing errors, suspected fraud, payment problems, shipping limitations, or other legitimate business reasons.

If payment has already been collected for an order that we cancel, the applicable amount will be refunded.

3. Pricing and Payment

Prices are shown in U.S. dollars unless otherwise indicated.

Applicable sales taxes and other charges will be displayed or calculated during checkout when required.

Payment must be successfully authorized through the payment methods available at checkout.

4. Shipping and Delivery

Shipping and delivery are governed by our Shipping Policy.

Delivery dates and transit times are estimates unless expressly stated otherwise. Carrier delays, weather, transportation disruptions, incorrect addresses, and other circumstances outside our reasonable control may affect delivery.

Customers are responsible for providing an accurate and complete shipping address.

5. Returns and Refunds

Returns, cancellations, refunds, damaged shipments, and related matters are governed by our Refund Policy.

Customers should contact DEV Traffic Systems before returning merchandise and follow the return instructions provided.

6. Product Compatibility

Customers are responsible for reviewing product specifications and determining whether a product is appropriate for their intended equipment and application before installation or use.

For replacement LED modules, visors, electrical components, and similar parts, relevant compatibility factors may include:

  • Dimensions
  • Voltage
  • Current and wattage requirements
  • Connector type
  • Polarity
  • Mounting configuration
  • Equipment model
  • Environmental requirements
  • Other electrical or mechanical specifications

Physical fit alone does not necessarily establish electrical or functional compatibility.

If you are uncertain about compatibility, contact DEV Traffic Systems before installation or use.

7. Installation and Safe Use

Products must be installed, operated, maintained, transported, and used according to applicable instructions, specifications, labels, warnings, and laws.

Traffic-control equipment must be deployed in accordance with applicable work-zone requirements and the requirements of the authority having jurisdiction over the applicable roadway or project.

Electrical equipment should be connected only to compatible power sources.

Immediately discontinue use of equipment that appears unsafe, including equipment displaying abnormal overheating, smoke, burning odors, exposed conductors, damaged batteries, significant structural damage, or other conditions indicating that continued operation may present a hazard.

8. Batteries and Electrical Components

Where products contain or use batteries:

  • Use compatible batteries and charging equipment.
  • Follow applicable voltage and charging requirements.
  • Do not intentionally crush, puncture, open, burn, or damage batteries.
  • Keep batteries away from excessive heat and open flames.
  • Discontinue use of swollen, leaking, unusually hot, or physically damaged batteries.
  • Follow applicable battery recycling and disposal requirements.

Product-specific instructions take precedence over general guidance in this section.

9. Limited Product Warranty

Unless a product listing or accompanying documentation expressly states otherwise, no separate DEV Traffic Systems warranty period should be assumed merely from the purchase of a product.

Where a product is expressly sold with a DEV Traffic Systems or manufacturer warranty, the applicable listing or documentation will identify the warranty and its duration.

A stated warranty generally does not cover damage resulting from:

  • Accident or physical damage.
  • Misuse, abuse, or neglect.
  • Improper installation.
  • Unauthorized modification or repair.
  • Failure to follow instructions or warnings.
  • Incompatible equipment or power sources.
  • Operation outside published specifications.
  • Normal cosmetic wear.
  • External events unrelated to a covered product defect.

Nothing in these Terms eliminates rights that cannot legally be waived.

10. Intellectual Property

Website content created or owned by DEV Traffic Systems, including applicable text, graphics, logos, product presentation, photographs, and other materials, may be protected by intellectual-property laws.

Nothing in these Terms grants permission to reproduce or commercially exploit DEV Traffic Systems-owned content except as permitted by law or with our authorization.

Third-party trademarks and materials remain the property of their respective owners.

11. Prohibited Uses

Customers may not use this website to engage in fraud, interfere with website operation or security, transmit malicious code, violate applicable law, misuse another person's information, or infringe intellectual-property rights.

12. Limitation of Liability

To the maximum extent permitted by applicable law, DEV Construction Corp. and DEV Traffic Systems are not responsible for losses or damages resulting from misuse, improper installation, unauthorized modification, use outside published specifications, or use with equipment known to be incompatible.

Nothing in these Terms excludes or limits liability that cannot legally be excluded or limited.

13. Third-Party Services

Our website may use services provided by Shopify, payment processors, shipping providers, and other third parties.

Use of certain third-party services may also be subject to the applicable provider's terms and policies.

14. Governing Law

These Terms are governed by applicable laws of the State of Texas and the United States, without limiting any rights a customer may have under laws that cannot contractually be waived.

15. Changes to These Terms

Changes do not eliminate rights concerning completed transactions where those rights cannot legally be modified.
